TERMS & RENTAL CONDITIONS CASA MATINE-BENISSA
1. RESERVATION & CONFIRMATION
After the written order to fix a rental period in Casa Matine, a provisional reservation is made. The reservation becomes final after transfer of the first down payment. By paying the first down payment, you declare that you agree with these conditions.
From June till October, Casa Matine can only be rented for 7 nights starting on Saturdays. The other periods, except for school holidays, the house can also be rented on other arrival and departure days with a minimum stay of 7 nights. In consultation, a shorter stay of 5 nights is sometimes possible.
2. PAYMENT
The first down payment is 30% of the agreed rental amount. This first down payment must be credited to the landlord's account within 4 days after the reservation order. After this, the reservation is final.The remaining amount of the rental sum (70%) plus the security deposit of €1.500 must be paid no later than 6 weeks before the start of the rental period. You must keep track of this yourself.
If Casa Matine is booked within six weeks before the start of the rental period, the full rental amount (including security deposit) must be paid immediately.
The agreed rental price is in Euros and
INCLUDING
use of gas (for the BBQ), water, electricity (up to a max consumption of 200kWh per week)- additional consumption (0,50€/kWh) will be deducted from the security deposit.
Excluded from Base Rental Price
Linen Rental (Mandatory – €25 per person)
The linen package includes:
Bed linen: Fitted sheet, duvet cover, and pillowcase (per person)
Bath linen:
1 shower towel (90 x 140 cm)
1 towel (50 x 100 cm)
2 guest towels (30 x 50 cm)
1 bath mat (per person)
Pool towel (beige – not to be used at the beach)
Kitchen linen (per package):
4 tea towels
1 dishcloth
Welcome package included
Note: Sleeping in beds without proper bed linen is not allowed.
Optional Extras
Beach towel: €4 per person (on request)
Mid-week linen change: €20 per person
Extra bed: €100 per person per week (maximum 2 beds)
Baby equipment (must be requested in advance):
Cot: €20 per stay (includes linen and towel)
High chair: €10 per stay
Final Cleaning (Mandatory – €400)
Tenants are required to leave the property tidy upon departure. Failure to do so may result in a deduction from the deposit.
Checklist for tidy departure:
All dishes clean and returned to cupboards
Fridge, dishwasher, and sink emptied
Oven and microwave cleaned (no grease or residue)
Barbecue cleaned (no grease or residue)
No garbage left behind
For stays over one week, an additional cleaning service is mandatory: €300
Additional Services (On Request)
Pool heating: Available up to 28°C. Additional energy use will be deducted from the security deposit
Elevator use: Available upon request with an extra €500 security deposit
3. SECURITY DEPOSIT
A security deposit of € 1.500 is required when booking. We will transfer the deposit back to your bank account 2 weeks after your departure, provided that no damage to the house is found and with offsetting any additional incidental costs. We expect you to leave the house and terraces tidy, run the dishwasher, remove bedding, clean-the barbecue, take out the trash, place all furniture and equipment in their places. Any additional costs such as extra bed and bath linen and additional costs for electricity consumption above 200kWH per week (at €0.50 per kWh) will be settled with the deposit.
In case of late payment, the reservation will be automatically cancelled and the cancellation conditions below will also apply.
4. DAMAGE
During the first 24 hours of the stay in the accommodation, the tenant must send an e-mail to contact@casamatine.com if any malfunctions, breakages and / or damage have been found. After 24 hours, Casa Marine assumes that no malfunctions, breakages and / or damage have been found, and that the accommodation is in good condition. During the stay the tenant must in all cases of breakage, loss and / or damage immediately report this to Casa Matine, this will be deducted from the deposit. If Casa Matine finds any breakage, loss and / or damage after the departure of the tenant, Casa Matine will report this and deduct it from the deposit. Photos of the problems may always be added for clarification.
5. CANCELLATION
Cancellation by the tenant:
Any cancellation must be notified to us in writing by email. The date of the email is decisive.
In case of cancellation we will charge the following cancellation costs:
cancellation up to 6 weeks before the start of the rental period: 30%
cancellation after 6 weeks before the start of the rental period: 100%
The percentages are calculated on the total rental amount excluding cleaning costs, deposit, etc.
If you, as a tenant, do not use the holiday home or use the house for only part of the rental period, no refund of payments will take place.
Cancellation by the landlord:
If we have to cancel a rental agreement due to force majeure, the tenant will be informed immediately and any payments (down payments) will be refunded.
By force majeure we mean all circumstances that prevent the fulfilment of the rental agreement and that are not attributable to us. In the event of attributable circumstances, we will do our utmost to find a good alternative for you.
6. ARRIVAL & DEPARTURE TIME
Casa Matine is available on the day of arrival from 17:00 to 20:00. In case of a later arrival than 20:00 a surcharge of €40 will be charged.
When leaving on the last day of the rental period, you must leave the house before 10:00.
7. INSURANCE
Cancellation insurance is not included in the reservation. We advise you to take out travel and cancellation insurance for cancellation, interruption or termination of the trip and to cover damage and/or calamities.
8. HOUSE RULES
Pets are not allowed.
Groups of young people are not allowed.
Parties and celebrations are not allowed.
Smoking is not permitted indoors.
The house may not be occupied by a larger number of people than agreed upon without consultation (not even temporarily).
If the house is occupied by more people than agreed, the landlord has the right to terminate the rental agreement with immediate effect and the tenant is obliged to vacate the house immediately.
When no one is in the house, even temporarily, the house must be left properly locked.
Please be considerate of your neighbours. No loud music or loud noises between 10pm and 8am. Please also be considerate of your neighbours during the day.
Swimming pool: Every user is obliged to take a shower before going into the water to remove any creams or oils. The pool can become green due to more than these products and will be unusable for up to 3 days. Glasses, cups, plates etc are forbidden around and in the swimming pool. Any type of manipulation by the tenant can lead to sanctions. Pay attention when the tiles are wet, they can be slippery. The pool is ground floor with the terrace and the house and not always lockable. Casa Marine recommends that children who cannot swim yet always wear armbands/swimvests outside.
9. INTERNET & INTERNET TV
WIFI is available at the accommodation.
Internet TV is available, but this does not mean that the reception includes all stations.
10. LIABILITY OF THE TENANT
You are obliged to occupy the holiday home as a “good tenant” and to follow the instructions provided there regarding the use of installations and equipment.
On arrival you will find the house clean. We would appreciate it if you leave the house neat and tidy with all furniture in its original place.
All household waste must be taken to the designated containers in the area before departure.
The BBQ must be left cleaned.
Bed linen should be removed and left in a pile in the bathroom together with towels.
As a tenant, you are responsible for the house, the furnishings and all items that belong to the rented object. If during your stay damage or loss occurs that is attributable to you, or to one of your fellow travellers, you are liable for this and must be compensated.
If you notice upon arrival at Casa Matine that something is not in order or broken, please report this immediately.
11. LIABILITY OF THE LANDLORD
We will fulfil our obligations as a landlord to the best of our ability, but we accept no liability for:
Inconveniences and damage due to interruption of water, internet connection or electricity caused by the work of third parties or weather conditions.
Inconvenience due to construction work in the area.
Loss, theft or damage to luggage, personal belongings or vehicle.
Injuries sustained in and around the home, and the consequential damage thereof.
Complaints procedure:
If you have any complaints, we will do everything we can to resolve them, if it is within our power and to the extent that the complaints are reasonable. We want to ensure that you have a pleasant holiday. However, we can only do this if you inform us of this immediately. You can also report a complaint to us in writing afterwards, but at that point your holiday is already over.
Disputes:
Unless mandatory rules of international law provide otherwise, Belgian law applies to this agreement and disputes will be settled by the Belgian court.
